Abstract

The Cuestionario de Predicción de la Judicialización de las Relaciones Familiares (C-JUDIFA), also known as the Questionnaire for the Prediction of Judicialized Family Relationships, is designed to assess the risk of conflicts between former partners escalating to the judicial system. This 59-item questionnaire evaluates nine dimensions that are considered integral to family judicialization, based on existing measures such as the Divorce Adjustment Questionnaire (CAD-S; Yárnoz-Yaben & Comino-González, 2010) and the Divorce Unresolved Grief Scale (Yárnoz-Yaben, 2017). These dimensions include adjustment to divorce, grief before separation, hate towards the ex-partner, forgiveness of the ex-partner, positive co-parenting, conflict with the ex-partner, excessive involvement of families of origin, triangulating dynamics, and the influence of the judicial system. The instrument was developed with permission and authorization from the original authors, and modifications were made for contextual adaptation. Content validity was established through expert item analysis. Psychometric evaluation involved data from adults with partner and/or family experiences, with reported analyses covering confirmatory factor analysis, test reliability, and validity.

Purpose

The C-JUDIFA was developed to identify factors that predict the likelihood of family conflicts being resolved through the judicial system. Its aim is to aid in the prevention of such problems and to serve as a valuable tool for mediation and family therapy practitioners, family courts, and social services.

Validity

Content Validity

Content validity was established through consultation with psychologists who are experts in mediation and family conflict. The scales “adjustment to divorce,” “parental coordination,” “conflict with ex-partner,” “triangulating dynamics,” “mourning before separation,” and “judicial system” achieved an average score close to 8. The scales “forgiveness to the ex-partner,” “entrenched hatred,” and “influence of the families of origin” obtained an average score close to 9.

Reliability

Internal Consistency

The omega reliability coefficient (McDonald, 1999) was used to assess internal consistency. All scales demonstrated high reliability coefficients, with most exceeding .90. The “conflict with ex-partner” scale had the lowest reliability coefficient among them.

Factor Analysis

Confirmatory Factor Analysis

A parallel analysis of the nine scales indicated that each scale underlies a single dimension. For all scales, the data showed a good fit to the one-dimensional model, with RMSEA indices below .08 and CFI and GFI indices above .95 (Hu & Bentler, 1999). The findings also confirmed that the nine scales conform to the initially proposed theoretical model, where they are grouped into three distinct factors.
