LEARNED TREATISE EXCEPTION

an exception found in US case law through which experts are allowed (normally they are not) to discuss the potential opinions and findings of other experts during a testimony. See also opinion testimony.

LEARNED TREATISE EXCEPTION: “During court cases, experts are allowed to speculate with respect to an individual who has spoken under oath, normally speculation is not allowed but is covered in the learned treatise exception.”
